Dual sport/Green sticker question

For those of you that are plated in California, the way I understand it, is that there is NO requirement for a green sticker in addition to the plate, correct? I ask this for a buddy of mine. If this is correct, what is the vehicle code section that discusses this?

No, for almost everything around here if you're plated, you're golden. From what I understand there are a few trails in the Sierras that REQUIRE a green sticker - apparently a plate alone does not cut it on those trails. However I have no idea if it's enforced...

The only problem with running a plate as your sole source of registration (as I do on my 450 & 650) is that you're supposed to maintain all your street-legal equipment (i.e. mirrors, blinkers, etc...) which usually do not last long on the trail (well, they don't if you ride anything like me...).

If you strip that crap off you could be subject to a citation / fix-a-ticket if someone has a real stick up their butt...
 
I think that the vehicle code is gonna be key. Are you saying Chad that if the bike is missing mirrors, etc. that you can get a ticket while you are offroad?

The theory here is that if you have a jeep and you are offroad with no green sticker of course, you are not breaking the law. Why would a plated bike be any different?
 
I've looked at the vehicle code and some sections like tires have a "when operate on the highway" in them. However, some of the a-hole cops/rangers will enforce that. I've had a few law enforcement types mention my signals and mirrors, but I have never been cited, yet.

Now a sticking point is that all the lighting and the mirror must be DOT approved in order to be truly legal. I have a DOT headlight, but that is about it. The HID inside the headlight is not DOT compliant. Neither are my tail light or turn signals. My mirror is one of those foldable Acerbis jobs and it is too small to be compliant.

I do have DOT tires. I have been told on more than one occasion not to hit the pavement by law enforcement while on the dirt. That seems to be the most common thing looked at.

I've not yet encountered anywhere you could not go with a plate where you could with a green sticker. I have a feeling that it comes from verbiage like "Green sticker required" that you do see in many places. What those really mean is "registered vehicles only" and I think it is a misinterpretation to construe it as meaning a plate is not good enough.

My buddy was at the DMV this morning and was told it was "required" to have both if you do both. Crock of shit I think.:prof:
 
Yeah - DMV is full of shit about 98% of the time - I'd likely defer to Carl for most things vehicle-code in nature, since he always seems to produce said code on demand.

I do know that for District races, if you were using your plate as your form of current registration that 'technically' you were supposed to run all equipment legally required to satisfy the requirements of said registration. I think there were threats of enforcement from BLM that more likely than not never materialized...
 
I just retired from being a cop for 28 yrs and 15 as a motor cop. Been riding bikes since before there was a green sticker, that started in 72'. No OHV stickers are required to ride off road if you have a valid plate from any state or country. You do not have to have on highway legal equipment to ride off road. Its that simple. The Veh code does not tell what is legal, only tells you what is illegal or what you must do.

I don't think the BLM is using the same rule book as you. I don't know about other state or federal agencies, but the BLM has been clear about the requirement for street-legal equipment on street-legal bikes. Click it or ticket! (which is crazy because my bike didn't come with a seatbelt) :prof:
 
well if you doubt it or are concerned then I would call them up and ask them the question. Have them give the code that applies, not just some guy telling you his thots. I know of no law that applies that way. The law is the law.

So then, how do you fight some asshat at DMV saying you must have both? Do you ask them to produce the code? Fat chance. I deal with the courts every day and they make YOU come with the code section to prove them wrong.

But that said, seems to me there has to be something in the code that would give the requirement that OHV requires a green sticker and street legal requires a plate. So taking that logic, you show that section of the code that says that street legal only requires a plate?:blah::thinking:
