Here's a letter that I got from my US Senator regarding the CPSIA of 2008 (Consumer Product Safety Improvement Act).

So... a letter that indicates the commission feels they do not have the authority to grant exceptions to motorcycles, atvs, and bicycles regarding the lead content law that was passed by congress. But there is other legislation being introduced that might help either grant the exception or increase the commissions authority.

It has been a while since I last read about the topic.
